1. Agreement to Terms

By using Pop Color, you agree to these terms. If you do not agree, do not use our app or website. These terms form a legal contract between you and pixorafox.com.

2. Who Can Use Pop Color

Pop Color is for users of all ages. Children under 13 should use the app with parent guidance. By using Pop Color, you confirm that:

  • You can form a binding contract
  • You are not banned from using our services
  • You will follow all laws that apply to you

3. Your Account

You may use Pop Color without an account. If you create one:

  • Keep your login details safe
  • You are responsible for all activity on your account
  • Tell us right away if someone else uses your account
  • We may suspend accounts that break these terms

4. License to Use

We give you a limited license to use Pop Color. This license is:

  • Personal and non-commercial
  • Non-exclusive (others can use it too)
  • Non-transferable (you cannot give it to others)
  • Revocable (we can end it if you break rules)

5. Restrictions

You may NOT:

  • Copy, modify, or distribute the app
  • Reverse engineer or decompile the app
  • Remove copyright or trademark notices
  • Use the app for illegal purposes
  • Sell or rent access to the app
  • Use bots or automated tools
  • Try to hack or harm our systems
  • Harass other users
  • Upload harmful content
  • Pretend to be someone else

6. Intellectual Property

Pop Color and all its content belong to us. This includes:

  • The app design and code
  • All artwork and images
  • Logos and trademarks
  • Text and other content

You may share your completed artwork for personal use. You may not sell artwork created in Pop Color.

7. User Content

If you share content (like reviews or messages), you:

  • Keep ownership of your content
  • Give us permission to use it
  • Promise it does not break any laws
  • Accept we may remove content that breaks rules

8. Purchases and Payments

Pop Color offers in-app purchases. When you buy:

  • All sales are final
  • Prices may change without notice
  • Payments go through Apple or Google
  • We do not handle your payment details
  • Refunds follow store policies

Virtual items have no cash value. They cannot be traded or sold.

9. Subscriptions

If you subscribe to premium features:

  • Billing is automatic until you cancel
  • Cancel at least 24 hours before renewal
  • Manage subscriptions through your app store
  • No refunds for partial periods

10. Disclaimer of Warranties

Pop Color is provided "as is" without any warranty. We do not promise that:

  • The app will always work
  • The app will be error-free
  • The app will meet your needs
  • Your data will never be lost

Use Pop Color at your own risk.

11. Limitation of Liability

To the fullest extent allowed by law, we are not liable for:

  • Lost data or profits
  • Indirect or special damages
  • Damages from using or not using the app
  • Actions of other users

Our total liability is limited to the amount you paid us in the past 12 months.

12. Indemnification

You agree to defend and hold us harmless from claims arising from:

  • Your use of Pop Color
  • Your breach of these terms
  • Your violation of any rights

13. Third-Party Services

Pop Color may include links or services from third parties. We do not control these services. Their terms and policies apply to your use of them.

14. Affiliate Disclosure

We may earn money from links to products or services. This does not affect the price you pay. We only recommend things we believe are good.

15. Changes to Terms

We may update these terms. We will post changes here. Big changes will be noted in the app. Continued use means you accept new terms.

16. Termination

We may end your access to Pop Color at any time for any reason. You may stop using the app at any time. Upon termination:

  • Your license ends
  • You must stop using the app
  • We may delete your data

17. Governing Law and Jurisdiction

These terms are governed by the laws of Ontario, Canada. Any disputes will be resolved in the courts of Toronto, Ontario. You agree to this jurisdiction.

18. Dispute Resolution

Before going to court, you agree to try to resolve disputes by contacting us first. Email support@pixorafox.com with your concern.

19. Severability

If any part of these terms is found invalid, the rest still applies. The invalid part will be changed to reflect our intent.

20. Entire Agreement

These terms, along with our Privacy Policy and GDPR page, form the complete agreement. They replace any prior agreements.
